Rental Terms & Conditions

These Rental Terms & Conditions apply to all equipment hired from Cobble & Cot through cobbleandcot.com, by email, telephone, WhatsApp or any other booking method.

By placing a booking, you confirm that you have read and agree to these Terms.

1. About us

Throughout these Terms, "Cobble & Cot", "we", "us" and "our" refer to the business above. "Customer", "you" and "your" refer to the person making the booking.

2. What you are hiring

All equipment remains the property of Cobble & Cot at all times.

A booking gives you temporary possession and use of the equipment for the agreed rental period only.

You must not sell, sub-hire, lend, transfer, modify or dispose of any hired equipment.

Product photographs are for illustration, but we will make reasonable efforts to provide the exact product, model and colour booked.

Where this is not possible, we will contact you before supplying a substitute wherever reasonably practicable.

Any substitute will be of an equivalent or higher practical standard for the intended use. If you do not wish to accept a materially different substitute, you may cancel the affected item for a full refund.

3. Booking

A booking is confirmed when payment has been successfully received and you receive booking confirmation from us.

You are responsible for providing accurate booking information, including your name and contact details, delivery and collection addresses, accommodation details where relevant, rental dates and times, your child's age, height or weight where relevant to the equipment selected, and any other information reasonably required to fulfil the booking.

Please check your confirmation carefully and contact us as soon as possible if anything is incorrect.

4. Rental period

The rental period begins on the agreed delivery or collection date and ends on the agreed return or collection date.

Minimum rental charges may apply even where equipment is required for a shorter period. Any applicable minimum charge will be displayed before you complete your booking.

Keeping equipment beyond the agreed rental period requires our approval.

If you wish to extend your hire, please contact us as early as possible. Extensions are subject to availability and additional rental charges.

Unauthorised late returns may affect another family's booking. We may therefore charge reasonable additional rental costs and any direct losses reasonably caused by the late return.

We will always seek to resolve late returns proportionately and fairly.

5. Prices and payment

Prices shown on our website are in pounds sterling.

The total price of your booking, including applicable delivery or collection charges, will be shown before payment.

Payment is required to confirm a booking unless we agree otherwise in writing.

Cobble & Cot does not currently require a security deposit unless clearly stated before booking.

Not requiring a deposit does not remove the customer's responsibility to take reasonable care of hired equipment or liability for loss or damage caused by misuse, negligence or failure to comply with these Terms.

6. Delivery and collection

Delivery and collection options, areas and charges are displayed on our website and/or during checkout.

We deliver to locations including hotels, serviced apartments, holiday accommodation and other agreed addresses across our delivery area.

Where delivery is made to hotel reception, accommodation staff, a concierge or another person authorised by you, the equipment will be treated as delivered to you when accepted on your behalf.

You are responsible for ensuring that the property, hotel or accommodation allows us to deliver and/or collect equipment and that reception or another authorised person is available where required.

Please provide any access instructions before delivery.

Delivery and collection times are agreed as accurately as reasonably possible, but exact timings may occasionally be affected by traffic, weather, access restrictions or circumstances outside our reasonable control.

We will keep you informed if a significant delay occurs.

7. Receiving the equipment

Please check the equipment as soon as reasonably possible after receiving it.

If anything appears missing, damaged, faulty, excessively worn or unsuitable, stop using the affected item and contact us promptly.

Photos are helpful where there is visible damage.

If you discover a safety concern during the rental period, stop using the item immediately and contact us.

Where equipment develops a fault that was not caused by misuse or customer damage, we will take reasonable steps to repair, replace or collect the item as appropriate.

Your statutory consumer rights are not affected.

8. Condition, cleaning and safety checks

Equipment is cleaned and checked between hires in accordance with our cleaning and inspection procedures.

Normal signs of previous use may be present on rental equipment. Cosmetic wear that does not affect the safe use or function of the equipment is not considered a defect.

Safety-critical equipment is inspected before hire.

If we identify damage or wear that could affect safe use, the equipment will not be rented until the issue has been appropriately resolved.

Customers must follow all safety warnings, age limits, weight limits and manufacturer instructions provided with or applicable to the equipment.

9. Using the equipment

You are responsible for using hired equipment safely and appropriately.

You must follow the manufacturer's instructions, observe age, height and weight limits, use straps, harnesses, brakes and safety features correctly, supervise children appropriately, keep equipment away from avoidable hazards and stop using equipment if you believe it may be damaged or unsafe.

Equipment must only be used for its intended purpose.

You must not alter, dismantle or attempt to repair equipment without our agreement, except for normal adjustments described in the manufacturer's instructions.

10. Car seats

It is your responsibility to select a car seat that is suitable for the child and compatible with the vehicle in which it will be used.

Information provided by Cobble & Cot about age, height, weight, compatibility or installation is intended to help you choose an appropriate product but does not replace the manufacturer's instructions.

Unless we specifically agree to provide an installation service, the customer is responsible for installing the car seat correctly in accordance with the manufacturer's instructions and applicable law.

If you are unsure whether a seat is suitable for your child or vehicle, please contact us before booking.

Do not use a car seat if it appears damaged or if you have any concern about its condition. Contact us immediately.

A car seat involved in a road traffic collision during your rental must no longer be used and must be reported to us immediately, regardless of whether visible damage is present.

Nothing in these Terms limits any responsibility that cannot legally be excluded.

11. Travel cots and sleep equipment

Customers are responsible for using travel cots and sleep equipment in accordance with the manufacturer's instructions.

Only mattresses and components approved for use with the relevant product should be used.

Do not add unsuitable mattresses, padding or accessories to travel cots.

Customers remain responsible for deciding whether a product is appropriate for their child's individual needs.

12. Strollers, prams, carriers and high chairs

All restraints and safety features must be used in accordance with the manufacturer's instructions.

Do not exceed the stated child or storage weight limits.

Strollers and prams must not be left unattended with a child inside where doing so would create a safety risk.

Baby carriers must be adjusted and used in accordance with the manufacturer's guidance.

High chairs must be used on a stable surface and children must be appropriately restrained and supervised.

13. Customer care of equipment

We understand that baby equipment is used in real life and ordinary wear is expected.

You will not be charged for reasonable wear arising from normal use.

Please take reasonable care of the equipment and return it in broadly the same condition in which it was supplied, allowing for normal wear and reasonable use.

Please do not intentionally remove labels, serial numbers or identification markings.

Equipment should not be exposed unnecessarily to smoke, fire, excessive moisture or other conditions likely to cause avoidable damage.

14. Loss, theft and damage

Please tell us as soon as possible if equipment is lost, stolen or damaged.

Customers may be responsible for reasonable repair or replacement costs where loss or damage results from deliberate damage, negligence, misuse, failure to follow manufacturer instructions, unauthorised modification, failure to take reasonable care, or loss or theft while the equipment is in the customer's possession.

We will not charge for normal wear and tear.

We will assess damage fairly and reasonably.

Where repair is possible and proportionate, we will normally charge the reasonable cost of repair rather than automatically charging the full replacement value.

Where an item is lost, stolen, damaged beyond economic repair or rendered unsafe for further use due to circumstances for which the customer is responsible, we may charge a reasonable amount reflecting the cost of replacing the item with an equivalent item, taking account where appropriate of its age, condition and existing wear.

We may request photographs, information about the circumstances or, in the case of theft, a police incident or crime reference where reasonably appropriate.

Any amount sought will reflect our actual reasonable loss and will not be used as a penalty.

15. Cleaning

Ordinary cleaning associated with normal family use is included in the rental price.

We do not charge customers simply because an item requires standard cleaning after normal use.

However, where equipment is returned in a condition requiring exceptional specialist cleaning because of avoidable misuse, we may charge a reasonable amount reflecting the additional cost actually incurred.

Examples may include significant staining, smoke contamination, deliberate marking or contamination requiring specialist treatment.

We will contact you before applying any additional cleaning charge and explain the basis of the charge.

16. Lost accessories or components

Please return all accessories, adapters, rain covers, inserts, bags, chargers, straps, manuals and other components supplied with the item.

If something is accidentally left behind, contact us as soon as possible.

Where a component is not returned and cannot reasonably be recovered, we may charge the reasonable cost of replacing it.

17. Cancellations and refunds

Our Cancellation & Refund Policy forms part of these Terms.

Nothing in our cancellation policy removes any statutory cancellation or refund rights that apply to you.

Where UK consumer law gives you rights beyond our voluntary cancellation policy, those rights take precedence.

18. Changes by Cobble & Cot

Very occasionally we may be unable to fulfil a booking because equipment has been unexpectedly damaged, returned late, recalled or becomes unavailable for another reason outside our reasonable control.

Where this happens, we will contact you as soon as reasonably possible.

We may offer a suitable equivalent or upgraded replacement, a change to the booking, or a refund for the unavailable item.

We will not substitute materially different safety equipment without informing you.

19. Manufacturer recalls and safety notices

If a product becomes subject to a manufacturer or official safety recall, we may immediately withdraw it from rental.

If this affects an existing booking, we will contact the customer and arrange an appropriate replacement or refund.

20. Our responsibility to you

We are responsible for supplying equipment as described and with the standards required by applicable consumer law.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or statutory consumer rights that cannot legally be excluded.

We are not responsible for losses that were not reasonably foreseeable when the contract was made, or losses arising from customer misuse, incorrect installation or failure to follow clear manufacturer instructions, except where the law provides otherwise.

Nothing in these Terms affects your statutory rights.

21. Events outside our reasonable control

We will not be responsible for failing to perform an obligation where performance is prevented by events outside our reasonable control.

These may include severe weather, road closures, major transport disruption, emergency restrictions or other exceptional events.

Where possible, we will contact you and take reasonable steps to minimise the effect on your booking.

23. Personal information

We process personal information in accordance with our Privacy Policy.

24. Changes to these Terms

We may update these Terms from time to time.

The Terms that apply to your booking will normally be those in force when the booking was made, unless a change is required by law or is agreed with you.

25. Governing law

These Terms are governed by the laws of Scotland.

If you are a consumer, you retain any mandatory legal rights regarding where proceedings may be brought.

26. Entire agreement

These Terms, together with your booking confirmation and any policies expressly incorporated into them, form the agreement between you and Cobble & Cot.

Nothing in these Terms affects rights that cannot lawfully be excluded or restricted.
